  1. The promoter of the Ipswich First Weekly Giveaway is Ipswich City Council, 50 South Street, Ipswich 4305.
  2. Information on how to enter forms part of these Terms & Conditions. By entering or participating in this Competition, each participant fully and unconditionally agrees and acknowledges that these Terms & Conditions of Entry and the decisions of Council on all matters relating to this Competition are final.

WHO CAN ENTER

  1. Subject to these Terms & Conditions of Entry, entry is open to all Queensland residents over the age of 18.
  1. All people who “subscribe” or “opt in” to receive Ipswich First will be automatically entered into the prize draw.

RESTRICTIONS ON ENTRY

  1. Employees, Directors (and their immediate families) of Council, Council’s related companies, contractors and agencies are ineligible to receive a prize.
  2. Entrants must provide an active email address in order to be considered eligible for entry.
  3. The Council (or a person nominated by Council) reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms & Conditions of Entry or who tampers with the entry process. Failure by Council to enforce any of its rights at any stage does not constitute a waiver of those rights.

COMPETITION PERIOD

  1. The Competition opens at 12:00pm (AEST) on 7 August 2017 and closes at 2pm (AEST) on 15 September 2017 when the final prize is drawn. One prize will be drawn each Friday, from August 11 until September 15, as outlined in details of the competition prize at clause 8.
  1. Council reserves to the right to terminate the Competition at any time for any reason, including before any prize is drawn.

COMPETITION PRIZE

  1. There are six prizes to be won. Each prize will be drawn on the following dates specified below.
  • August 11: Flight for two people with Pterodactyl Helicopters, including lunch at Sundowner Saloon. Prize value $490.
  • August 18: One night for two people (Sunday to Thursday) at Spicers Hidden Vale, including dinner. Prize value $519.
  • August 25: Two rounds of golf at Brookwater Golf and Country Club, including a $100 voucher redeemable at the country club restaurant. Prize value $340.
  • September 1: An early-morning hot air balloon ride (approximately one hour) and breakfast with Floating Images. Prize value $660.
  • September 8: Two dining vouchers, each to the value of $100, redeemable separately at Pumpyard Bar and Brewery and Dovetail Restaurant. Prize value $200.
  • September 15: V8 Driver Experience, including 6 laps and tuition, for two people. Prize value $398.
  1. Each winner must organise their own transport to and from prize destinations. The total prize value is $2607. Any costs and charges which are not included in the prize allocation will be the responsibility of the respective winners of each prize.

HOW TO ENTER AND ENTRY CONDITIONS

  1. All eligible people who opt in to receive Ipswich First will be entered automatically into the draw.
  2. Winners will be contacted by the valid email address they have supplied. When contacted, the winner will be required to supply their full and correct name. Winners who choose to collect prizes in person will be asked for legal identification. Winners who provide an address for delivery of their prize may be asked to verify their address.
  3. People who do not comply with these Terms & Conditions of Entry will be deemed ineligible to win a prize.
  4. The Council reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process, for engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition or for submitting an entry that is not in accordance with these Terms & Conditions of Entry.

PRIZE DRAWS

  1. The Prize draw will take place at Ipswich City Council, Level 2, IGIC Building, 30 South Street, Ipswich 4305, each Friday from August 11 until September 15. One winner will be chosen at random from the “Ipswich First” opt in database, via the use of a number randomiser.
  2. The winner will be notified by email within 2 business days of the draw. If the winner has not contacted the Council within 14 days of the competition draw, a re-draw will take place, and a new winner identified.
  3. The Council’s decision is final and no correspondence will be entered into regarding the Competition result.

PRIZE RESTRICTIONS

  1. If a person who is ineligible to receive a prize is drawn for a prize, the prize will be redrawn
  2. Unless expressly stated in these Terms & Conditions of Entry all other expenses involved in the Prize are the responsibility of the Prize winner. Where a prize includes travel, the prize must be booked and completed as specified by the Council and/or the supplier or organiser of the prize. If the prize is event based, travel must be taken to coincide with the relevant event on the dates specified by the Council or the supplier. Any flights and accommodation constituting part of a prize are subject to booking and availability. All costs associated with a travel prize which are not specified to be included in the prize, including but not limited to any transfer costs, meals, taxes, insurance and other ancillary costs, are the responsibility of the winner and their companion/s. The Council is not responsible for any cancellation, delay or rescheduling and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner.
  3. Each Prize (or any component of the Prize) must be taken as offered and is not exchangeable, transferable, redeemable for cash or for resale. In the event for any reason the Prize winner does not take any component of the Prize within the time stipulated or otherwise provided by the supplier, or in accordance with these terms and conditions then that component will be forfeited by the Prize winner and cash will not be supplied in lieu of that component of the Prize. Where a component of the Prize is unavailable for any reason, the Council may, in its sole discretion, substitute another comparable component of equal or higher value as determined by the Council in its sole discretion.
  4. Prize values are GST inclusive and are in Australian dollars. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Council accepts no responsibility for any variation in Prize value.
  1. If for any reason this Competition is not capable of running as planned for any reason beyond the reasonable control of the Council (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Council which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition), the Council reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition, subject to any written directions made under State or Territory legislation.
  2. The Council is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  3. The Council accepts no responsibility for any tax implications that may arise from winning the Prize. Independent financial advice should be sought.
  4. The Prize must be taken as stated and no compensation will be payable if the winner is unable to use the Prize as stated.
  5. The prize to Spicers Hidden Vale is valid for a weekday stay only, from Sunday to Thursday night. The dinner package is per adult and is not inclusive of drinks. The winner is required to liaise directly with Spicers Hidden Vale, and the voucher will be valid for one year as per the date on the voucher. It is not transferrable for cash or other items.
  6. The prize to Brookwater Golf and Country Club is valid for a 12-month period from the date of the voucher, and will expire in July 2018. The winner is required to liaise directly with Brookwater. The prize is not transferrable for cash or other items.
  7. The prize with Pterodactyl Helicopters is valid until July 2018. The winner is required to liaise directly with Pterodactyl Helicopters for bookings. The prize is not transferrable for cash or other items.
  8. The prize with Floating Images Hot Air Balloon Flights is valid until August 2018. The winner is required to book directly with Floating Images, and bookings will be dependent on availability – as is the case with all prizes. The prize is not transferrable for cash or other items. Floating Images terms and conditions apply. Check the company’s website for more details.
  9. Vouchers to Pumpyard Bar and Brewery, and Dovetails Restaurant, are not transferrable for cash or other items. The winner will be required to book directly with the restaurants, and are subject to availability.
  10. The V8 driver experience winner will be required to book direct with Queensland Raceways. The prize is not transferrable for cash or other items.

COLLECTION OF PERSONAL INFORMATION

  1. By participating in the Competition entrants agree that Ipswich City Council may use the entrant’s personal information for the purposes of running the Competition and awarding Prizes.
  1. Council’s Privacy Statement and Personal Information Digest apply and are available at: http://www.ipswich.qld.gov.au/about_council/corporate_publications/privacy.
  2. Council is collecting your personal information for the purposes of conducting the competition and supplying you with Ipswich First. We may need to disclose your personal information to relevant Council departments.

DISCLAIMER AND RELEASE

  1. Certain legislation may imply warranties or conditions or impose other obligations including statutory consumer guarantees which cannot be excluded, restricted or modified except to a limited extent. To the extent permitted by law, the Council excludes all guarantees, warranties, conditions or other terms that apply under or are implied by statute, common law or trade custom or usage.
  2. If in the conduct of this Competition Council is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other Commonwealth, State or Territory law that cannot be excluded, the Council’s liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.
  3. To the extent permitted by law, each entrant and the Prize winner (including any person that consumes the Prize with the Prize winner) irrevocably waives all rights against the Council and its related companies, its employees, servants, agents, independent contractors or representatives (together, the ‘Indemnified Persons’) and releases and discharges the Indemnified Persons from all claims, liability, costs, expenses, damages or losses (whether direct, indirect or consequential and whether arising under statute, from negligence, personal injury, death, property damage or otherwise) arising from or in connection with the Competition or the Prize. These terms do not limit or exclude liability to the extent that liability cannot, by law, be limited or excluded.
  4. To the extent permitted by law, neither the Council nor any of its related companies or associated agencies accepts any liability to the prize winner(s) or anyone else for any injury, damages, expenses or loss whatsoever (including without limitation loss of profit, revenue or business and indirect, consequential, special or incidental loss or damage), relating to entry into the Competition or which is sustained in the course of accepting or using a prize.
